The landscape of criminal defense practice is rapidly evolving. Technological advancements are reshaping the way we communicate with our clients, how we store and manage ever-growing volumes of discovery data in our cases, and the tools that we use to prepare our defenses. This program will explore the ethical implications of electronic communications with clients and third parties; best practices to maintain confidentiality of those communications; storage of sensitive client and case data; and some of the ethical considerations of utilizing AI tools in our legal practices, including information sharing concerns and related confidentiality issues; as well as addressing best practices for utilizing any AI tools in legal practice.

Joshua Horowitz, an expert litigator in technological complex criminal and civil cases involving digital forensics, internet networking data and data reconstruction will help describe, demystify and discuss the technology, operations and ethical obligations that every conscientious criminal practitioner needs to know. (You may recall that Josh, a stalwart NYCBA member, created and moderated our previous Metadata CLE webinar in 2022.)

The New York Criminal Bar Association has been certified by the New York State Continuing Legal Education Board as an Accredited Provider of continuing legal education. This program has been approved in accordance with the requirements of the New York State Continuing Legal Education Board for a maximum of one and one-half (1.5) credit hours which can be applied toward the Cybersecurity, Privacy and Data Protection – Ethics or Ethics requirement. This program is open to experienced and newly admitted attorneys alike.

The program is offered for FREE to all current 2025 NYCBA members, institutional defender office attorneys, and unemployed attorneys. Assigned counsel (NYC Assigned Counsel Plan [“18-B” panel] or federal CJA Panel members) may pay a discounted rate of $19.99.
